Booking Conditions
- What you need to know

- Embarkation:
- Embarkation time is normally after 1200hrs and disembarkation is 0900hrs. However, we will be more than delighted to accommodate you earlier or allow you to stay onboard later if we have no guests that day.

- Luggage:
- Space is restricted for storing large cases. We would recommend folding baggage.

- What is included in the price:
- Some of our clients charter Yacht Imagine fully catered at an additional charge. It is up to you to decide if you require breakfast, lunch and dinner. We can stock up at your request mineral water, soft drinks, beers, wine and spirits. Don't forget to let us know your favourite drink so we can stock up for you. The only exclusion is champagne.
- Unlike most other yacht charters we include the cost of all fuel and anchorage fees (where applicable). If you decide to berth at a marina you would have to pay that locally to the skipper.
- You have full use of all the facilities onboard Yacht Image without charge, apart from the Satellite telephone.
- The skipper and chef are also included in the price we give you, which again is usually added as an extra on other yachts.
- All bedding (changed three times a week), towels and toiletries are supplied without charge.

- Smoking:
- Not permitted down below decks, however allowed at the aft deck seats.

- Food preferences:
- We will contact you prior to your arrival to find out your food dislikes, preferences and any allergies.

- Booking Conditions:
- Booking Your Holiday:
- Bookings are made with SalyMar.SA Mallorca. Only when the booking form and payment have been received by the Company does a contract exist whereupon a balance invoice/booking confirmation will be forwarded to you.

- Jurisdiction:
- Your contract with Salymar.SA shall be governed by Spanish law.

- Payment:
- A deposit of 50% will be payable. The balance of the payment for the holiday must be received 4 weeks prior to departure and the signatory on the booking form guarantees payment on behalf of all those people featured on the booking form. If the balance is not received by the due date the Company reserves the right to cancel the holiday, retain the deposit. Bookings made within the 4 week period must be paid in full at the time of booking. The individual who makes the booking is responsible for all payments.

- Circumstances beyond our control:
- Except where we say differently elsewhere in these conditions, we cannot pay any compensation, expenses, losses or any other amount or otherwise accept responsibility if we have to change your holiday after departure or if we or our suppliers cannot provide your holiday as we had agreed, or you suffer any loss or damage of any description as a result of circumstances beyond our control. When we refer to circumstances beyond our control, we mean any event which we or the supplier in question could not foresee or avoid even after taking all reasonable care. Such circumstances will usually include war, terrorist activity, civil unrest, industrial dispute and bad weather (actual or threatened) which is not known to us in advance of your departure date.

- If we change or cancel your holiday:
- The Company reserves the right to use alternative arrangements should circumstances force a change from any advertised itinerary. The Company will do everything in its power to advise you as quickly as possible. Agents who supply the service are at all times acting only as agents to the persons or the company supplying the service. The Company will not accept any liability for injury, damage, loss, delays, inconvenience or extra expenses incurred by the client nor for any other claims due to the actions of any person or company providing such services. Once your holiday has started the Company will not be liable for any loss, delay, inconvenience or extra expenses caused to the client for any reason beyond its control. Please note, compensation will not be payable and we will not otherwise be liable to you if we are forced to cancel, delay or curtail or in any way change your holiday as a result of force majeure detailed above.

- If you change or cancel your booking:
- If you want to change your booking, please contact us immediately and we will do our best to assist you. We will charge for any additional items changed, at the price which applies on the day the change is made. Please note that no changes can be made less than 4 weeks prior to departure without incurring cancellation charges. We reserve the right to make a charge of £100 for the administration involved in altering a booking after the holiday arrangements have been made.

- If you cancel your booking:
- Cancellations must be made in writing or by e:mail, by the signatory who booked the holiday. Cancellations must be received by the Company prior to the departure date to be valid. The date that written cancellation is received at our office will be the date used to determine cancellation charges.

- Our liability to you:
- Our obligations, and those of our suppliers providing any service or facility involved in any of your Holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities and, where we or our supplier are actually providing the service or facility, to provide them with reasonable skill and care. In respect of International travel by air, sea and rail, the extent of our liability will in all cases be limited as if we were carriers under the appropriate Conventions, which include The Warsaw/Montreal Convention (international travel by air); The Athens Convention (with respect to sea travel); The Berne/Cotif Convention (with respect to rail travel) and The Paris Convention (with respect to accommodation arrangements). You can ask for copies of these Conventions from our offices upon request.

- Your responsibility to us:
- We want all our customers to have an enjoyable, carefree Holiday. But you must remember that you are responsible for your actions and the effect they may have on others. If we (or another person in authority) believe your actions could upset our suppliers or our own staff, or put them in danger or damage property, we reserve the right to end your Holiday and our responsibilities under the contract will end.

- Travel:
- All passport, visa and travel insurance and health certificate requirements are your responsibility and Yacht Imagine.Com accept no responsibility for any delay or expense incurred through any irregularity in your documents.

- Complaints:
- In the event that you feel you have cause to complain during your holiday, please report the matter to our crew immediately. Any complaint which cannot be resolved should followed up in writing.

- Data Protection:
- Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us in respect of your holiday arrangements, unless you agree otherwise. For example, if we wish to use any of your personal details for marketing purposes, we will tell you this when we ask for your details and give you the opportunity to say no if you do not want us to do so.

- Special requests and less mobile passengers:
- We will do our utmost to honour any special requirements you may have. Before making a booking we will need to know if you have any medical/physical/mobility needs which might affect how and if we can deliver all your chosen holiday. We would ask therefore that you submit any special needs/requirements to us in writing before making a reservation. A checklist for disabled and less mobile passengers can be obtained by contacting us directly and will need to be completed and signed by you before your booking can proceed. Please note that completion of this form will not guarantee your needs will be met. It will however enable us to check the suitability of the yacht for your requirements. We cannot be held liable if you fail to tell us about any special requirements that may affect the quality of your holiday.
